Classifications of Law:

In this introduction to the Law, I will explain the differences between the main categories of the Law so you can understand how it affects you on a daily basis.

Public vs. Private Law?

Public law is any law enacted or approved by someone in a public or governmental position. Examples of such laws include state and federal laws, as well as aspects such as state and federal securities laws, partnership and incorporation procedures, as well as zoning and development classification rules.
Private law, on the other hand, is created and conducted by two or more individuals to govern their interactions. An example here includes a contract law as agreed between tenants of property and their owners. Another example would be the Associations of Homeowners in which the standards of living in a specific area are governed. Although the procedures to form the contract law may be governed by the Public Law,

The Importance of Administrative Law ?

When this legal body, which is also considered a branch of public law, is not strictly regulated, it can alter the balance in areas such as police law, international trade, manufacturing, the environment, taxes, broadcasting, immigration and transportation. One of the main responsibilities of administrative law is the application of a specific regulatory agenda. When regulation and adjudication are not followed as stated above, it is similar to allowing the 'fox to watch the hen house'.

Under the New Deal legislative plan, President Franklind. Roosevelt and the Democratic Congress enacted several statutes that created new federal agencies to help the United States overcome the economic shortages of the Great Depression. During this time, opponents of The New Deal worried that the nation would allow the extensive government, putting the United States in a position of possible dictatorship. In 1946, after ten years of detailed study of administrative regulation, the Administrative Procedure Law (APA) became law.

To provide constitutional guarantees, the APA develops a scheme for regulatory agencies and their functions. The basic purposes of the APA are:

(1) require agencies to keep the public informed about their organization, procedures and rules;
(2) provide for public participation in the regulatory process;
(3) establish uniform standards for the formal conduct of regulation and adjudication;
(4) Define the scope of the judicial review.

What to Know About Online Trade Laws?

In today's modern world, buying and selling through the Internet is no longer new. Online stores and auction sites have sprung up here and there. Almost all people have an online account; and almost all companies have a website. In fact, more people choose to buy and sell online. Anyone can trade on the Internet as long as they have an account verified online. However, there is still no total freedom when it comes to online transactions. There are online business laws that both the seller and the buyer must comply with. These online business laws keep everything systematic and orderly.

When you register with an auction site or an online store, you must read and understand the policy of that particular site. The fine print usually includes governance rules such as membership rules, return policies, dispute resolution systems, and transaction fees.
 As you know, the commerce network is very broad and every day there is a large amount of information on the Internet. Due to this, the risk of phishing and identity theft increases. In fact, according to the FTC or the Federal Trade Commission, more than nine million Americans have their identities compromised every year. And instead of becoming useful, technological advances only make things worse. Scammers often use modern technology to initiate more fraudulent activities. Fortunately, most legitimate websites have reliable security systems. If you have complied with the commercial laws online and have provided your real name, SSS number, email address, telephone number and address to the site.

  Law and International Trade

The most basic international trade laws are related to tariffs and subsidies and other forms of trade protection that unfairly benefit certain countries in trade relations. The World Trade Organization was established in 1995 and represents the most important development in the history of international commercial law. before that, there existed the GATT treaties, which is the abbreviation of the General Agreement on Tariffs and Trade. The law of international trade originated due to the economic liberalism that developed in Europe and the United States in the eighteenth century and later. The main functions of the World Trade Organization are to regulate unfair trade practices, such as tariff dumping and subsidies, and there are also some aspects of human rights in the work of the World Trade Organization.

 What is the tariff?

A tariff is a government regulation imposed by the national government that makes the importation of the product in that country more expensive. The reason why this problem matters in that country is that it makes them more expensive than their local competitors. Trade unions often press national governments to protect their industries because union members want their jobs protected in these local industries. National governments often succumb to this political pressure to allow trade protections to be established, other justifications for this type of trade protections in the existence of an incipient industry. However, these ideas are at odds with the most basic theories of economic liberalism and international trade.

What is subsidy?

The subsidy is a payment made by the national government to support a local industry in order to lower a product for the final consumer and, therefore, be more competitive. This is another form of commercial protection used by national governments at the request of several internal interest groups. Your country that lobbies for these protections. Often, the long-term effect of these types of protection is that the industry becomes non-competitive globally and even more protected to survive the competitive market worldwide

Civil Law: What It Is, And How It Affects You?

Civil law is one of those issues that many people are unaware of (no, watching the television shows of the court is not a substitute for really learning what civil law is), and yet it affects them every day. If you are ever involved in litigation, you may need to hire a civil lawyer.

What Is Civil Law Anyway?

Civil law deals with the resolution of conflicts. This covers a wide range of specific areas, and civil lawyers (a.k.a litigants) usually specialize in one or two practices. A civil defense attorney can be found in the courtroom representing a defendant in a medical malpractice lawsuit and the next day they could resolve a dispute related to environmental law.Think of it this way: many centuries ago, I could have witnessed two champions, each selected by someone involved in a dispute, fighting each other.
The litigants of today act in a very similar capacity, but without the shedding of literal blood and the noise of weapons on the shields. Keep in mind that civil law refers to matters that do not include criminal charges such as murder, theft of weapons, arson, etc. That is the realm of the criminal lawyer.

 Under What Circumstances Should I Hire A Civil Defense Lawyer?

Before you start calling and sending emails, it is best to try to understand exactly what a civil law attorney does in your job.

Civil lawyers represent clients in trials instead of criminal trials. In general, a lawyer will not practice civil and criminal law. A victim has to hire his own civil lawyer, which means that he does not have the right to a lawyer provided by the court in a civil case.

If the litigation is about the money at stake, you want a civil lawyer. You will not go to jail if you lose a civil suit, so stay with a litigant. (Speaking of which, a civil lawyer can represent the defendants or plaintiffs).

You may have heard the term "insurance defense lawyer". This refers to a lawyer who specializes in representing defendants in civil cases related to insurance claims.

Criminal Law?

In contrast to civil law, criminal law involves crimes against the state, government or society in general, rather than a private party or person. Criminal violations, such as felonies and minor offenses, are subject to state and federal penalties; therefore, the jail time of the guilty person, government fines and, in extreme cases, the death penalty. Although a murder is a crime against a person, the crime itself goes against state and federal laws, so it is a criminal case, not a civil one. These cases go to a jury trial in which the defendants are prosecuted by the state. In criminal litigation, defendants can appoint their own lawyer, or have the state assign them one if they can not afford one.

 The Difference Between Criminal Law and Civil Law?

There are two comprehensive categories of law used in the legal system of the United States: civil law and criminal law. Although they are separate types of cases, some crimes can be both a civil and criminal violation of the law.
Any person convicted of a civil offense or offense will not be subjected to jail terms, government fines or the death penalty. Instead, most civil litigation ends with a negligent party ordered to compensate the injured party for its losses and any additional damage caused by the negligence of the defendant. The compensation is often paid by the defendant's insurance provider, but sometimes, they must pay out of pocket. If they do not have money, property or insurance, an injured person can not receive any reward, even if ordered by a court.
In criminal law, the burden of proof shifts to a more complex principle. First, it is always up to state prosecutors to provide evidence to prove that a defendant is guilty. All people are innocent until proven guilty, so the defendant has no obligation to prove his innocence in a criminal case. There are some exceptions to this rule, in the case of dementia claims and self-defense claims.

What is Property Law?

The property law is part of the legal system of customary law and refers to all aspects of the ownership of "real" property (ownership of the land instead of ownership of personal property) and personal property (personal property) .

The concept of property law has existed since the times of ancient Rome and the civil body of Emperor Justinian, who was responsible for dividing civil law into three categories: personal status, property and acquisition of property. The concept of property right as we know it today evolved outside the feudal system of France and was the first successful implementation of such a law, called the Napoleonic Code, based on the ideals of Justinian.
Today's property laws ensure that the rights and legal obligations of a person surrounding your property are protected. This is a branch of the law where it is especially important to be informed, as it directly affects people more than any other sector of the law. The numbers of lawyers in existence are many; however, do not go to any lawyer for any dispute related to the property. Property law is a specialized field that needs the skills of a solid professional with prior experience in property law

Property Law in United Kingdom:

In modern political theory, the United Kingdom is often considered as a country of countries. Therefore, it should not be surprising to know that the United Kingdom has three ownership systems that are adapted to the jurisdiction of the three decentralized national administrative entities: England and Wales, Scotland and Northern Ireland. The systems of property rights in the three national administrative entities in the United Kingdom follow the principles of the Common Law system. However, there are big differences. The system of Scottish property law has its roots in the system of feudal law.
The property laws of the United Kingdom make a clear distinction between two types: real and individual property. This is a stark contrast to the Civil Law system, where the distinction between movable and immovable property is made. Real estate can only have limited property, while an individual can have absolute ownership. The rent, the dowry or the escheat do not apply to personal property under the laws of the United Kingdom. The transfer of ownership of real estate can occur only through a notarial deed.

Community Property & Your Debt:

Debt relief issues - Understanding community property
Community property states are those that have adopted laws that state that property acquired during a marriage is joint property and is divided when the couple divorces, annuls the marriage or when one of the spouses dies. Unless there is a specific situation, it is automatically assumed that joint ownership is the case by law. Anyone who lives in one of these states is responsible for all debts that are acquired during the marriage, even if their name is not explicitly listed in the accounts.

A creditor can sue the user / spouse not authorized by the debt if the surviving spouse fails. In the event that a judgment is granted, a creditor may also impose a lien against real property or request the liquidation of other assets to settle the debt. Each state has its own set of exemptions that a debtor can claim to protect its property.

Owning and renting a property:

The United Kingdom is rapidly becoming a country divided between landlords and tenants. The seemingly endless trend of property price increases simply leaves many buyers who stay behind for even the first time in their search for home ownership. With each passing month and with each new property survey that takes place, many people are seeing how their dream of owning a home simply disappears.

The biggest problem, of course, is the fact that the income of most people has not increased in the same way that property prices have in the last 10 years. House prices have skyrocketed so far against so many incomes that at first glance it seems that home ownership alone is a viable option for higher rate taxpayers
For many potential buyers, the first obstacle that many find so difficult to overcome is finding a deposit substantial enough to place it. There are 100% mortgages available, however, these can be difficult to access and can leave the borrower with a negative equity.

It is becoming very popular for many first-time buyers to obtain an interest mortgage only to achieve a lower monthly payment. The combination of high levels of indebtedness with an interest mortgage is only considered a false economy: the full capital remains outstanding at the end of the term of the mortgage. Mortgages of interest have only increased in popularity in recent years
